Requests to Remove IID

About Interlock Device Removal

If you are on DUI Diversion and were required by the judge to install an Interlock Device (IID), you may request that the court remove this requirement after six months of using the IID or if you qualify for a medical exemption under Oregon Department of Transportation rules. There is no court fee to request removal. 

6 months of No Negative Reports. The court considers several factors when a request to remove an IID is made including:

  1. Treatment compliance and engagement in treatment;
  2. Whether the defendant has relapsed on drugs or alcohol during diversion;
  3. Whether the defendant is following all requirements of diversion including the payment plan to repay court fees; and
  4. Whether the Victim Impact Panel was completed.

Medical Exemption. The court considers several factors when a request to remove an IID is made including:

  1. Supporting statements from the medical provider
  2. Treatment compliance and engagement in treatment;
  3. Whether the defendant has relapsed on drugs or alcohol during diversion;
  4. Whether the defendant is following all requirements of diversion including the payment plan to repay court fees; and
  5. Whether the Victim Impact Panel was completed.

Document Checklist:

  • DMV IID Certification “6 month No Negative Report”;
  • Alcohol/Drug Treatment Completion Certificate;
  • Victim Impact Panel Completion Certificate; and 
  • Motion and Order to Vacate Use of IID as Condition of Diversion Agreement and Declaration in Support (call the court to get this document emailed to you).
